Natural Born Citizen

There seems to be a LOT of confusion as to what is a natural born citizen! It has been CLEARLY spelled out MANY times in our laws! Since Public Law 414 was written AFTER the enactment of the 14th Amendment, which was never properly ratified, it defines that rather vague Amendment!

Public Law 414 - June 27, 1952

DEFINITIONS

Section 101 (a)

(27) The term "nonquota immigrant" means-

(A) an immigrant who is the child or the spouse of a citizen of the United States;

(B) an immigrant, lawfully admitted for permanent residence, who is returning from a temporary visit abroad;

(C) an immigrant who was born in Canada, the Republic of Mexico, the Republic of Cuba, the Republic of Haiti, the Dominican Republic, the Canal Zone, or an independent country of Central or South America, and the spouse or the child of any such immigrant, if accompanying or following to join him;

(D) an immigrant who was a citizen of the United States and may, under section 324 (a) or 327 of title III, apply for reacquisition of citizenship;

NATIONALS AND CITIZENS OF THE UNITED STATES AT BIRTH

SEC. 301.

(a) The following shall be nationals and citizens of the United States at birth:

(1) a person born in the United States, and subject to the jurisdiction thereof;

(2) a person born in the United States to a member of an Indian, Eskimo, Aleutian, or other aboriginal tribe: Provided, That the granting of citizenship under this subsection shall not in any manner impair or otherwise affect the right of such person to tribal or other property;

(3) a person born outside of the United States and its outlying possessions of parents both of whom are citizens of the United States and one of whom has had a residence in the United States or one of its outlying possessions, prior to the birth of such person;

(4) a person born outside of the United States and its outlying possessions of parents one of whom is a citizen of the United States who has been physically present in the United States or one of its outlying possessions for a continuous period of one year prior to the birth of such person, and the other of whom is a national, but not a citizen of the United States;

NATIONALS BUT NOT CITIZENS OF THE UNITED STATES AT BIRTH

SEC. 308.

Unless otherwise provided in section 301 of this title, the following shall be nationals, but not citizens, of the United States at birth:

(1) A person born in an outlying possession of the United States on or after the date of formal acquisition of such possession;

(2) A person born outside the United States and its outlying possessions of parents both of whom are nationals, but not citizens, of the United States, and have had a residence in the United States, or one of its outlying possessions prior to the birth of such person; and

(3) A person of unknown parentage found in an outlying possession of the United States while under the age of five years, until shown, prior to his attaining the age of twenty-one years., not to have been born in such outlying possession.

CHILD BORN OUTSIDE OF UNITED STATES OF ALIEN PARENT; CONDITIONS UNDER WHICH CITIZENSHIP AUTOMATICALLY ACQUIRED

SEC. 321. (a) A child born outside of the United States of alien parents, or of an alien parent. and a citizen parent who has subsequently lost citizenship of the United States, becomes a citizen of the United States upon fulfillment of the following conditions:

(1) The naturalization of both parents; or

(2) The naturalization of the surviving parent if one of the parents is deceased; or

(3) The naturalization of the parent having legal custody of the child when there has been a legal separation of the parents or the naturalization of the mother if the child was born out of wedlock and the paternity of the child has not been established by legitimation; and if

(4) Such naturalization takes place while such child is under the age of sixteen years; and

(5) Such child is residing in the United States pursuant to a lawful admission for permanent residence at the time of the naturalization of the parent last naturalized under clause (1) of this subsection, or the parent naturalized under clause (2) or (3) of this subsection, or thereafter begins to reside permanently in the United States while under the age of sixteen years. (b) Subsection (a) of this section shall not apply to an adopted child.

US Constitution Article 2 Section 1
No person except a NATURAL BORN CITIZEN (NBC), or a citizen of the United States, at the time of the adoption of this Constitution,(this had to be added so the newly formed Constitution  could include those who adopted the Constitution) shall be eligible to the office of President; neither shall any person be eligible to that office who shall not have attained to the age of thirty five years, and been fourteen Years a resident within the United States.

A legal opinion on natural born citizen!

ANY and all court rulings in contradiction to this LAW are false and should be REVERSED! I challenge EVERYONE who disagrees with this to show me the LAW that repeals or replaces this section of Public Law 414!
Amendment 14

Section. 1. All persons born or naturalized in the United States and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.

The fourteenth Amendment says NOTHING regarding a NATURAL born citizen! It does distinguish between those subject to the jurisdiction of America, here LEGALLY, and those who enter ILLEGALLY!

By refusing to grant the legitimate requests of the states for an Article V Convention (to propose amendments to the Constitution), all three branches of the U.S. government are now operating as a "rogue" government outside the law. Under Article V of the Constitution, the states may request the Congress to establish a Convention to propose amendments to the Constitution. The states have done this by submitting over 500 requests to the federal government.

The Constitution established a Republican form of government consisting of the President, Congress and Supreme Court. These three bodies were designed to "check and balance" each other so that there could not be an assumption of absolute power by any one party or political group. The judiciary was to pass judgment on the constitutionality of the laws passed by the Congress and could void these laws as "unconstitutional." The President administered the Constitution and statutory laws created by the legislature.

An oath of office is an affirmation a person takes before undertaking the duties of an office, usually a position in government or within a religious body, and it is typical to believe the person taking the oath not only intends on fulfilling that “affirmation,” they actually comprehend what they are swearing to uphold.

At the start of the current session of Congress, every politician stood and repeated that, “I do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservation or purpose of evasion; and that I will well and faithfully discharge the duties of the office on which I am about to enter. Can the Supreme Court make a decision that violates the US Constitution?

No, they can't make a decision that violates the Constitution. Article III, Section 2 of the Constitution states that "The judicial power shall extend to all cases, in law and equity, arising under this Constitution." 

Our system is a balance of powers. Congress has the power to pass laws, the President has the power to enforce laws, and the Court has the power to interpret the laws. The Court has a very limited role: they get to say what the law is, and it should be beyond question that they have that power. But they have absolutely no way of making the rest of us comply with that determination. That is the check on their power.

It is scary to think what they are NOT teaching in schools!

Indentured Servants in America. In Colonial America, indentured slaves did not only consist of Africans, but a large majority of them were Irish, Scottish, English, and Germans, who were brought over from Europe and were paying their debt for the passage over sea.

Anthony Johnson. Anthony Johnson was one of the first African Americans to have finished his services as an indentured servant and become a landowner on the Eastern Shore and slave-owner himself.

Slavery was also an integral part of African social structure before the Atlantic slave trade. Reasons for enslavement included prisoners of war, personal profit, judicial processes, economic need, and religion. Slavery in Africa was not more or less humane, but it differed because slaves were incorporated into the social structures of households. The main difference between early forms of slavery and the Atlantic slave trade is that previous to Nathaniel Bacon's Rebellion, race was not what constituted who was and who was not considered a slave.

H.R. 1599 would negate all of these laws, and more–according to the Center for Food Safety. The preemption language in the bill would nullify over a hundred local laws that, directly or indirectly, regulate genetically engineered crops. This is a DIRECT violation of the Declaration of Independence! The power of GOVERNMENT is limited by the power of the STATES/PEOPLE!

Rafael Edward "Ted" Cruz was 'elected' as Senator of Texas in 2012. He started the process of 'naturalization' in 2004 or 2005 - as of yet, 2016, the FINAL paperwork to complete that process has not been done- WHY?? Because he would be ADMITTING he is not eligible to be president!! .He didn't renounce his Canadian citizenship until 14 May 2014!  Doesn't that make him ineligible to be a Senator? Doesn't THAT prove he is NOT eligible to be president?
